End user license agreement

IMPORTANT — READ CAREFULLY. Please review the rights and restrictions outlined in this End User License Agreement (“EULA”).

Agreement

This agreement is between you and IMPULSE MEDIA HUB and its affiliates (the “Company”). The software and any accompanying printed materials are licensed to you as an individual, provided you accept all the terms of this EULA.

By installing or using the Software, you agree to be bound by this EULA. If you do not accept its terms:

  • Do not install or use the Software.
  • If you purchased the Software, return it with proof of purchase to the place of purchase for a refund.

During installation, you will be asked to review and accept (or decline) this EULA by clicking “I Accept.” By clicking “I Accept,” you confirm that you have read, understood, and agreed to its terms.

The Software is protected by copyright laws and international treaties, as well as other intellectual property laws. All rights (including copyright) to the Software (including images, photos, animations, videos, music, text, and embedded “firmware”) and any accompanying printed materials belong to the Company or its licensors (“Licensor”).

License grant

The Software is licensed, not sold, under this EULA. The Company grants you a limited, personal, non-exclusive license to use the Software on your device. All rights not expressly granted are reserved by the Company.

Permitted uses

  • If the Software is designed for hard drive installation, you may install and use it on one device only.
  • You may make one backup/archival copy, provided you retain the original and backup.
  • You may permanently transfer all rights under this EULA, provided:
    • You keep no copies.
    • You transfer all components (including documents and updates).
    • The recipient accepts this EULA.

Restrictions

You may NOT:

  • Remove or hide copyright/trademark notices.
  • Decompile, modify, disassemble, or reverse-engineer the Software.
  • Copy, rent, lease, sublicense, distribute, publicly display, or create derivative works (except as allowed under “Editor and User Modifications”).
  • Electronically transfer the Software between devices or over a network.
  • Use backup copies for purposes other than replacing a damaged original.

Trial versions

If the Software is a trial (limited time/uses), you agree to stop using it after the trial ends. The Software may include code to enforce these limits, which may remain on your device after uninstallation to prevent reuse.

Editor & user modifications

If the Software includes an editor tool, you may create modifications (“Mods”), provided:

  • Mods work only with a fully licensed copy.
  • No executable files are altered.
  • Mods contain no defamatory, illegal, or third-party IP (trademarks/copyrighted material).
  • Mods are not sold or commercialized (e.g., as part of a paid service).

Termination

This EULA remains in effect until terminated. You may terminate it by destroying the Software. The Company may terminate it immediately if you breach any terms. Sections on warranties, liability, and remedies survive termination.

Limited warranty & disclaimers

The Software is provided “AS IS.” The Company warrants that the physical media (if any) will be free of defects for 30 days from purchase. If defective, your sole remedy is a free replacement.

No other warranties: Except as required by law, the Company disclaims all warranties (including merchantability, fitness for a purpose, and non-infringement). The Company does not guarantee that the Software will meet your needs or be error-free.

Liability limitation

The Company will not be liable for:

  • Incidental, indirect, or punitive damages (e.g., lost profits, data loss, business interruption).
  • Any damages exceeding the amount you paid for the Software.

Some jurisdictions do not allow these exclusions; they may not apply to you.

Governing law & disputes

This EULA is governed by French law. Any disputes must be resolved in the courts of Paris.

Miscellaneous

If any part of this EULA is deemed invalid, the rest remains enforceable. This EULA is the entire agreement between you and the Company regarding the Software.
